All students deserve to be educated in safe and fair environments. In an effort to ensure these are true for students with disabilities, two offices in the U.S. Department of Education recently published documents for educators. In July 2022, the Office of Special Education Rehabilitative Services published Questions and Answers: Addressing the Needs of Children with Disabilities and IDEA’s Discipline Provisions, and the Office for Civil Rights published Supporting Students with Disabilities and Avoiding the Discriminatory Use of Student Discipline under Section 504 of the Rehabilitation Act of 1973.
